TERMS AND CONDITIONS

Effective Date: 01/01/2026
Last Updated: 10.01.2026

These Terms and Conditions (“Terms”) govern use of www.bloomcopublishing.com and purchases of products, educational programs, and services offered by [full legal entity name], doing business as Bloom & Co. Publishing(“Company,” “we,” “us,” or “our”).

Contact Email: info@bloomcopress.com

1. Scope and Acceptance

Please read these Terms before using our website or making a purchase.

Where these Terms form part of a purchase or service transaction, we will present them for acceptance before the transaction is completed. Merely displaying these Terms does not replace any acceptance required by applicable law.

If you do not agree to the applicable Terms, do not complete the purchase or use the restricted materials or services.

A separately signed Publishing Services Agreement or other written agreement governs the services covered by that agreement. If there is a conflict, the separately signed agreement controls for that project.

2. Eligibility and Account Information

You must be at least 18 years old, or have appropriate parent or guardian authorization, to purchase products or enter a service agreement.

You agree to provide accurate contact, billing, registration, and account information.

If you create an account, keep your login credentials secure and promptly report suspected unauthorized access. You are responsible for activity you authorize through your account.

3. Permitted Website Use

You may use this website for lawful purposes, including learning about our offerings, purchasing products, and contacting us.

You must not:

  • Attempt unauthorized access to accounts, systems, or private materials.
  • Introduce malware or interfere with website operation.
  • Use the website to commit fraud, impersonate another person, or submit misleading information.
  • Unlawfully copy, distribute, or commercially exploit protected content.
  • Collect other users’ personal information without lawful authority.
  • Submit unlawful, infringing, threatening, or harassing material.

We may restrict access where reasonably necessary to address violations, security risks, or unlawful activity. Restrictions do not eliminate obligations to provide paid services or applicable refunds.

4. Website Content and Intellectual Property

Except where otherwise identified, website text, branding, graphics, educational materials, videos, worksheets, and other original content are owned by the Company or used with permission.

Purchasing a book, course, or digital product does not transfer copyright or other intellectual-property ownership.

You may use purchased materials for your personal learning or other purposes expressly authorized with the product. You may not reproduce, resell, upload, share account access to, or distribute those materials without permission, except as permitted by applicable law.

Any included worksheet or template may be used for your own projects within the license stated with that product. It may not be resold as a separate product unless expressly authorized.

Third-party names, trademarks, and materials belong to their respective owners.

5. Product and Service Descriptions

We aim to provide accurate descriptions, prices, and availability information.

Book format, edition, dimensions, course contents, access duration, and included services are described on the relevant product or service page.

Photographs and mockups are illustrative. Screen settings and production processes may cause minor color or appearance differences. These differences do not excuse a materially incorrect or defective product.

If we identify a material listing or pricing error affecting an order, we will contact you before proceeding and offer an appropriate correction or cancellation with a refund of any payment for the canceled item.

6. Orders, Prices, and Payments

Prices are stated in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping costs, and other disclosed charges will be shown before you complete your purchase.

Payment is due according to the checkout terms or your written service agreement. Payment processing is performed through the providers identified at checkout.

We may decline or cancel an order for reasonable reasons, including suspected fraud, unavailable inventory, or an inability to fulfill the order. Payments for items we cancel without providing them will be refunded.

Price changes apply to future purchases and do not change an accepted order or signed agreement without your consent.

7. Physical Books and Shipping

Available shipping methods and estimated delivery periods are displayed at checkout or communicated with your order.

Delivery estimates may be affected by printing schedules, carrier delays, weather, and other circumstances. We will communicate material delays when reasonably possible.

Please provide an accurate delivery address. Additional shipping charges caused by an incorrect address may apply when disclosed and appropriate.

If a book arrives damaged, defective, or incorrect, contact us promptly with your order number and photographs where reasonably available. We will assess the issue and provide an appropriate replacement, refund, or other remedy.

Any request to report problems promptly does not shorten rights provided by applicable law.

8. Returns, Cancellations, and Refunds

Return eligibility, request periods, return shipping responsibilities, and any product-specific restrictions will be disclosed in the applicable Refund and Cancellation Policy or before purchase.

These Terms do not create an undisclosed blanket “no refunds” rule.

If no separate refund policy has been provided for your purchase, contact us to request a return or cancellation. We will review the request based on the product, its condition, fulfillment status, and applicable law.

Refunds and cancellations for custom publishing services are governed by the separately signed Publishing Services Agreement.

Nothing in these Terms restricts remedies for defective products, undelivered purchases, or other rights that cannot legally be waived.

9. Digital Products and Online Courses

Digital products and course access are provided according to the description shown before purchase.

Access duration, delivery method, included support, and any prerequisites will be stated with the offering. Lifetime access is not promised unless expressly stated and defined.

You are responsible for having the internet connection, compatible device, and software identified as necessary for access.

Course registrations and digital licenses are for the registered purchaser unless otherwise stated. Unauthorized sharing, copying, resale, or redistribution is prohibited.

If you cannot access purchased materials, contact us so we can help resolve the issue. If we cannot provide the purchased access, we will offer an appropriate remedy, subject to applicable law.

10. Educational Information and Business Outcomes

Our books, classes, consultations, worksheets, and website materials provide educational and general informational content.

They do not substitute for individualized legal, tax, accounting, financial, or other regulated professional advice.

You remain responsible for decisions concerning your manuscript, business, publication strategy, pricing, and marketing.

We do not guarantee:

  • Book sales, royalties, profits, or income.
  • Bestseller status, awards, or positive reviews.
  • Retailer, bookstore, or library acceptance.
  • Employment, certification, or business success.
  • Advertising performance, media coverage, or audience growth.
  • Film, television, licensing, or other commercial opportunities.

Examples, testimonials, and projections are illustrative and do not promise your results. This provision does not excuse failure to deliver expressly purchased products or services.

11. Publishing Services and Author Rights

Publishing-service scope, deliverables, schedules, payment terms, proof approval, ownership, permissions, and any distribution or royalty arrangements must be specified in a written agreement.

Submitting a manuscript or contacting us does not transfer your copyright to the Company.

An inquiry or upload does not authorize publication. Publication requires the permissions and approvals described in the applicable agreement.

Do not submit materials you lack authority to provide. You are responsible for obtaining permissions required for your submitted content.

12. Submitted Materials and Feedback

When you send information or materials, you authorize us to review and use them as reasonably necessary to respond to your request or perform authorized services.

That permission does not authorize unrelated publication, resale, or public disclosure of an unpublished manuscript.

For nonconfidential suggestions about our website or services, you permit us to use the suggestions to improve our offerings without compensation. This does not transfer ownership of your manuscript or other creative work.

Identifiable testimonials, customer photographs, and project examples will be used in marketing only with any permission required by applicable law.

13. Third-Party Services and Links

Our website may link to payment providers, retailers, printers, distributors, social platforms, or other third-party services.

Those providers have their own terms and policies. Review them before using their services.

We do not control independent third-party decisions or guarantee their uninterrupted operation. This provision does not eliminate our responsibility for our own conduct or contractual obligations.

A link does not necessarily constitute endorsement of the linked website or all of its content.

14. Privacy

Our Privacy Policy describes how we collect, use, disclose, and retain personal information.

Do not send complete payment-card information, Social Security numbers, or other unnecessary sensitive information through ordinary email or general inquiry forms.

A separately signed confidentiality or service agreement may provide additional obligations for a specific project.

15. Website Availability and Warranties

We use reasonable efforts to maintain website functionality, but access may be interrupted for maintenance, technical problems, or circumstances beyond our reasonable control.

To the extent permitted by law, free general website content is provided “as available,” without a guarantee that every item is complete, current, or suitable for every purpose.

This provision does not disclaim expressly promised product or service features, applicable statutory warranties, or obligations that cannot legally be excluded.

16. LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM WEBSITE USE OR A PURCHASE, INCLUDING SPECULATIVE LOST SALES OR PROFITS.

TO THE EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY FOR A CLAIM CONCERNING A PRODUCT OR SERVICE WILL NOT EXCEED THE TOTAL AMOUNT PAID OR PAYABLE FOR THE AFFECTED PRODUCT OR SERVICE.

These limitations do not apply to fraud, intentional misconduct, gross negligence, or liability that applicable law prohibits limiting.

A separately signed service agreement may establish different liability terms for the services it covers.

Nothing in these Terms removes nonwaivable consumer rights or prevents access to remedies required by law.

17. Responsibility for Unlawful Submissions

You are responsible for your own unlawful use of the website and for content you submit without necessary rights or permissions.

Any indemnification obligations for a publishing project must be stated in the applicable signed agreement. These website Terms do not impose an unlimited obligation to pay every claim or expense incurred by the Company.

18. Complaints and Disputes

Please contact info@bloomcopress.com with questions or complaints. Include relevant order or project information so we can investigate.

We will attempt to resolve disputes through good-faith communication. The Parties may agree to mediation.

These Terms do not require arbitration, waive jury-trial rights, prohibit government complaints, or prevent legally available small-claims proceedings.

North Carolina law governs to the extent permitted, except where another applicable law cannot be displaced.

Any court proceeding must be brought in a court with proper jurisdiction and venue. Mandatory protections concerning a consumer’s location remain applicable.

Each Party bears its own legal fees unless applicable law, a court order, or an enforceable separately signed agreement provides otherwise.

19. Changes to These Terms

We may update these Terms for future website use and future transactions. The updated version will display its effective date.

Changes do not retroactively alter an existing order or signed agreement without the consent required by applicable law.

Where affirmative acceptance or additional notice is required, we will provide it.

20. General Provisions

If a provision is unenforceable, the remaining provisions continue to the extent legally permitted.

Failure to enforce a provision on one occasion does not waive future enforcement.

No provision should be interpreted to exclude a responsibility or right that cannot legally be excluded.
